You must provide accurate information and keep your login credentials and API keys confidential. You are responsible for all activity under your account and API keys. You must be at least 18 years old and legally able to enter into these Terms. Notify us promptly of any unauthorized use.
As between you and Pulse, you own the data you submit ("Customer Data"). You grant us a worldwide, non-exclusive license to host, process, and use Customer Data to provide and improve the Service and as described in our Privacy Policy. We own the Service itself, including the software, SDK, and dashboard, and all related intellectual property. We may use aggregated, de-identified data that does not identify you or any individual to operate and improve the Service.
The Service integrates with third parties such as TikTok and relies on infrastructure providers such as Supabase and GitHub. Your use of those services is subject to their terms, and we are not responsible for their acts, omissions, availability, or changes to their APIs.
Ad attribution is inherently estimated and probabilistic. Platform privacy features (including Apple's App Tracking Transparency and SKAdNetwork) limit device-level measurement. Pulse's results are provided for informational purposes and are not guaranteed to be complete or accurate. You should not rely on them as the sole basis for financial or legal decisions.
We may modify, suspend, or discontinue any part of the Service at any time. We aim for reliable availability but do not guarantee uninterrupted or error-free operation. This build may include mock or in-development features.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD 100 IF YOU HAVE NOT PAID US).
You agree to indemnify and hold Pulse harmless from claims arising out of your Customer Data, your use of the Service, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.
